En punto de las 4:10 de la mañana de este viernes, la Cámara de Diputados aprobó la reforma en materia de Telecomunicaciones. Con 414 votos a favor, 50 en contra y dos abstenciones, han sido formuladas 60 reservas al texto.
Minutos antes de las 8 de la noche del jueves, el presidente de la Comisión de Puntos Constitucionales, Julio César Moreno, abrió la sesión con el siguiente discurso:

“Como no se hacía desde 1960, hoy abriremos un debate que establecerá sustancialmente la legislación en materia de telecomunicaciones, con la reforma constitucional que significará un verdadero avance tecnológico, social y político en el campo de las telecomunicaciones en nuestro país”, finalizó.
El dictamen reforma siete artículos de la Constitución y que contempla la creación de dos nuevos órganos reguladores del mercado con autonomía: La Comisión Federal de Competencia Económica y el Instituto Federal de Telecomunicaciones, encargado de otorgar concesiones, previa opinión técnica y no vinculante de la SCT. Permitir hasta 100% de inversión extranjera en telecomunicaciones y 49% en radio y televisión; pero esta última en reciprocidad con el país en el que se encuentre constituido el inversionista.
Otros puntos importantes son:
- La creación de tribunales especializados en materia de telecomunicaciones.
- La licitación de dos nuevas cadenas de televisión.
- Acceso a internet y a la banda ancha para niños y jóvenes estudiantes.
Asimismo, el “must carry”, que obliga a los sistemas de TV de pago a distribuir las señales de TV abierta disponibles en su zona de influencia, y “must offer”, que obliga a los titulares de las señales a permitir en forma gratuita que los cableoperadores y sistemas satelitales toman sus señales abiertas mientras no sean ‘dominantes’; estos deberán pagar por esas señales.
Se incluyeron para determinar con mayor claridad entre los sistemas que se considera ‘dominantes’ –en principio definidos como aquellos que tienen más del 50% de los usuarios en un cierto mercado– y los restantes. Este criterio se aplicaría tanto a televisión como a telecomunicaciones, por lo cual algunos sostienen que, como consecuencia, se podría llegar a obligar a Teléfonos de México, empresa de Carlos Slim, a desprenderse de activos.
Con respecto al reemplazo de la Comisión Federal de Telecomunicaciones (Cofetel) por un nuevo ente, llamado Instituto Federal de Telecomunicaciones, se encomendó la preparación de un informe técnico a la Secretaría de Comunicaciones y Transporte, que deberá presentarlo en un plazo de 45 días.
Una vez aprobado en Diputados, el proyecto debe pasar al Senado, donde se ha anticipado que se invitará a figuras de la industria a exponer sus puntos de vista sobre la cuestión.
